COVID-19 Workers' Comp Legislation to Follow & PPP Interim Guidance

COVID-19 Workers' Compensation Legislation

There are currently four COVID-19 related workers' compensation bills pending in the Legislature. Two of particular concern to us include: 

SB 1159 (Hill)
This legislation is similar to the Governor's Executive Order, however, as proposed it could extend the presumption past the July date in the Governor's Order. It has passed out of Senate Labor Committee and is now pending in Senate Appropriations Committee where it will likely be heard in early June.

AB 196 (Gonzalez)
This bill would create a “conclusive presumption” of compensability, compensability, meaning an employer could not rebut the presumption that COVID-19 was contracted at the worksite. This significantly expands our industry’s liability beyond the Governor’s Executive Order. The Workers’ Compensation Insurance Rating Bureau has estimated the cost to employers of this to be $11.5 billion. The Senate Labor Committee has indicated that the bill will not be considered for hearing until mid-July.

CA State Budget Proposal Would Return State Highway Account Interest to Transportation Programming

Today, the California State Senate Budget and Fiscal Review Committee brought up their version of the state budget in response to the Governor’s May Budget Revise. As we previously shared, the Governor’s May Budget Revise had no structural changes to transportation programs and revenues in the state. The only revenue the Governor sought to redirect was the interest earned on the State Highway Account. The Senate’s proposal being deliberated this afternoon would seek to return that $130 million in interest to the State Highway Account.

Additional Guidance & Interim Rules on the Paycheck Protection Program (PPP):
The U.S. Small Business Administration (SBA) has finally released interim final rules (IFR) governing the PPP, providing additional clarity on what borrowers should know about the program and how review and forgiveness will be applied. Specifically, the IFRs cover PPP loan forgiveness, the good faith loan need safe harbors and the SBA’s loan review process.
