Urgent 2020 Legislative Updates

On December 31, the Federal court issued an injunction to stay enforcement of AB5 as to motor carriers pending a full hearing on the motion made by the Trucking Industry on January 13.

While the filing by the Trucking Industry was made specific to freight carriers, it remains to be seen how the District Court will rule on both the filing and how it will impact trucking in the construction industry.  Contractors are advised to continue to comply with the enacted requirements of AB5 until otherwise advised.  If further counsel is required, we advise contractors obtain legal counsel for information and recommendations.  AGC will continue to monitor the progress of the issue and provide updates as information becomes available.

New tools for AB 5 Compliance
AGC of California’s Legal Advisory Committee has drafted language for our members to utilize in purchase orders that will meet the requirements of Assembly Bill 5 (AB 5) beginning January 1, 2020. This language should be utilized when Purchase Orders are issued for work in the area of construction trucking services and acts as an arbitration agreement that has incorporated class-action waivers.

Skilled and Trained Workforce Requirements Change on January 1, 2020
January 1 of 2020 will bring new requirements for Skilled and Trained workforce on selected public works jobs, including additional public works jobs covered under Skilled and Trained Workforce statutes. For some trades, 60% of all journeypersons will be required to have a graduation certificate from their apprenticeable trade.
